What is a Trademark Show Cause Hearing?

When an examiner is not fully satisfied with the written objection reply, the Trade Marks Registry schedules a quasi-judicial 'Show Cause Hearing' under Rule 33 of the Trade Marks Rules, 2017.

Hearings are conducted before a Senior Hearing Officer or Assistant Registrar via online video conference. An experienced intellectual property advocate must appear on your behalf, present oral arguments, cite binding judicial precedents, and demonstrate why the mark is eligible for publication.

All trademark show cause hearings across India are now conducted virtually via online video conference (Cisco Webex). You do not need to visit any physical government office.
No. Once you execute Form TM-48 (Power of Attorney), our licensed intellectual property advocate represents you before the hearing officer. Your personal appearance is not required.
Failing to appear results in the application being summarily abandoned. However, if genuine emergencies arise, we can apply for an official adjournment (Form TM-M) before the hearing date.
The officer passes an order marking the mark as 'Accepted & Advertised'. The mark is then published in the official weekly Trade Marks Journal for the mandatory 4-month public opposition period.
